I. GENERAL TERMS (APPLICABLE TO ALL USERS)
1. Definitions
- Platform: Refers to PickARide.ng.
- User: Any person who accesses or registers on PickARide.ng, including buyers, sellers, renters, and rental providers.
- Verified Seller/Renter: A user whose documents and identity have been authenticated by PickARide.ng.
- Transaction: Any purchase, sale, or rental of a vehicle conducted through the platform.
2. Eligibility
You must be at least 18 years old and possess legal capacity to enter into binding contracts under Nigerian law to use this platform.
3. Account Registration
Users are required to create an account and provide accurate information. Users must verify their identity via email, phone, and government-issued ID. Businesses/corporations must provide CAC registration and additional details as required.
4. Platform Services
We provide listing, search, comparison, communication, payment facilitation, escrow services, and customer support tools for vehicle transactions (sales and rentals).
5. Fees and Commissions
Applicable fees and commissions are disclosed during listing or checkout. Users agree to:
- Sales Commission: 10% of completed sale transactions.
- Rental Commission: 10% of completed rental transactions.
- Listing & Subscription Fees: As per the pricing schedule published on the platform.
6. Payments & Escrow
All transactions must be processed via PickARide.ng’s secure payment gateway. Payments will be held in escrow until transaction confirmation, and both parties are satisfied with the transaction. Refunds and disbursements are processed per platform policy.
7. User Conduct
Users agree not to:
- Upload false or misleading information.
- Violate third-party rights or laws.
- Circumvent the platform for offline deals.
- Post duplicate listings or spam content.
8. Verification & Due Diligence
We conduct ID and document verification for individuals and businesses. Verified badges are issued post-verification. While we attempt to ensure accuracy, the platform is not liable for user-submitted misinformation.
9. Dispute Resolution
In the event of disputes, users are encouraged to contact platform support using the provided channels. Where unresolved, disputes may be referred to arbitration under the Arbitration and Mediation Act, 2023.
10. Limitation of Liability
PickARide.ng acts solely as a platform that facilitates connections between vehicle buyers, sellers, renters, and rental providers. While we provide verification services, escrow payment options, and support tools to enhance user safety and transparency, we do not take possession of vehicles, nor do we represent users in any capacity beyond platform facilitation.
To the maximum extent permitted under Nigerian law, PickARide.ng shall not be liable for:
- Any direct, indirect, incidental, or consequential damages resulting from a user’s reliance on vehicle listings, seller or renter representations, or any transaction conducted outside the platform.
- Inaccurate or misleading information posted by users, including but not limited to, false claims about vehicle ownership, condition, mileage, or registration status.
- Vehicle defects, mechanical issues, or title problems that arise post-transaction. Buyers and renters are strongly advised to inspect vehicles physically or request third-party assessments before concluding transactions.
- Incidents or accidents involving rented vehicles, including traffic violations, damages, theft, injury, and any other matter incidental thereto. Such matters must be resolved directly between the parties and, where applicable, their insurers.
- Losses resulting from failed or delayed payments, fraudulent activities by other users, or unauthorized access to user accounts due to compromised credentials.
Users agree to indemnify and hold harmless PickARide.ng, its staff, partners, and affiliates from any claim or demand made by any third party due to or arising from the user’s breach of these Terms or violation of any law or third-party rights.
11. Intellectual Property
All intellectual property rights relating to the platform’s design, logos, service descriptions, software, user interface, graphics, and content are the exclusive property of PickARide.ng or its
licensors.
Users may not:
- Reproduce, republish, redistribute, or copy any part of the website or mobile application
content without written consent. - Use automated tools (bots, crawlers, or scrapers) to extract data from the platform.
- Imply any partnership or endorsement without written prior agreement.
User-generated content such as vehicle listings, reviews, and uploaded media remain the intellectual property of the submitting user. However, by uploading such content, users grant PickARide.ng a non-exclusive, royalty-free, global license to use, modify, and display the content for promotional and operational purposes.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
In the event of any dispute, controversy, or claim arising out of or in connection with the use of the platform or these Terms:
- The parties shall first attempt to resolve the matter amicably through direct negotiation or platform-supported mediation.
- Where no resolution is achieved within 30 days, the matter may be referred to arbitration under the Arbitration and Mediation Act, 2023.
- The arbitration shall be conducted in Lagos, in English, by a single arbitrator mutually appointed by both parties, and the decision shall be final and binding.
Nothing in this section however, shall limit a party’s right to seek urgent injunctive or equitable relief in a court of competent jurisdiction.
13. Suspension and Termination of Accounts
PickARide.ng reserves the right to suspend, restrict, or permanently terminate a user’s account without prior notice if:
- The user is found to have submitted fraudulent documents or made false claims in connection with a listing or transaction.
- The user violates these Terms, platform policies, or applicable laws, including fraudulent activity, abuse, or harassment of other users.
- There is credible evidence or report of the user attempting to circumvent the platform’s payment system to avoid commissions or fees.
- The user’s actions pose a risk to platform security, disrupt operations, or harm PickARide.ng’s brand and community.
Suspended or terminated users shall forfeit access to platform features and may not re-register without express written permission. Any balances or funds in escrow will be withheld pending investigation or used to settle liabilities arising from violations.
II. TERMS SPECIFIC TO VEHICLE SALES
These terms apply to any user listing a vehicle for sale or purchasing a vehicle through PickARide.ng.
1. Vehicle Listings and Accuracy
- Sellers must provide complete and accurate information about the vehicle, including:
- Make, model, year, color, mileage, transmission type, fuel type
- Full disclosure of any past accidents, engine faults, modifications, or financing
- High-quality, unedited photographs showing different angles of the vehicle
- Verified documents: proof of ownership, registration, insurance certificate, and roadworthiness
- Listings are subject to moderation. PickARide.ng may reject or remove listings that:
- Contain false or unverifiable claims
- Violate copyright (e.g., stolen photos)
- Duplicate existing listings from the same seller
- Are considered suspicious or underpriced in ways typical of scam patterns
2. Seller Responsibilities
- Ensure that listed vehicles are legally owned and free from encumbrance or liens
- Respond to buyer inquiries promptly and professionally
- Make vehicles available for inspection at mutually agreed times and locations
- Confirm transactions via the platform and avoid off-platform arrangements that bypass platform transparency rules
- Cooperate in executing change of ownership documentation and physical handover once payment is confirmed
3. Buyer Responsibilities
Buyers agree to:
- Conduct due diligence before completing payment, including optional physical inspection or third-party assessments
- Use only the secure payment system and avoid paying cash or transferring directly to a seller without escrow protection
- Verify the documentation provided by the seller before accepting delivery or initiating transfer of ownership
Buyers understand that PickARide.ng does not act as an agent or representative of sellers and is
not liable for vehicle condition after sale.
4. Sales Verification and Ownership Transfer
Sellers are expected to cooperate in the full transfer process by providing:
- Signed change of ownership forms (as per VIO or FRSC requirements)
- Valid identification and authorization for joint ownership where applicable
- Tax clearance or proof of customs duties (if applicable)
Buyers are responsible for:
- Covering the cost of title transfer, change of plate number (if required), and related government fees
- Registering the new title in their name through the relevant authorities
5. Payment, Escrow, and Commission
The buyer pays the agreed price into PickARide.ng’s escrow system:
- Once both parties confirm the transaction and ownership is transferred, the seller receives
the balance, less:
- 10% commission on the final sale price
- Any applicable listing or verification fees
In case of dispute, funds may be held until investigation is concluded.
III. TERMS SPECIFIC TO VEHICLE RENTALS
These terms govern all vehicle rental transactions conducted on the platform, whether by individual owners or licensed rental companies.
1. Rental Listings and Requirements
Owners must:
- Provide accurate and complete information on each vehicle, including:
- Model, year, license plate, transmission type, fuel type
- Rental rate (hourly, daily, weekly), maximum distance, and additional charges in cases of
usage extension by the renter. - Availability calendar and pick-up/drop-off terms
- Upload current documentation, including:
- Proof of ownership, roadworthiness certificate
- Company CAC registration and fleet insurance (where applicable)
Owners are responsible for updating availability and removing listings that are no longer active.
2. Booking and Confirmation Process
- Renters browse listings and initiate bookings through the platform
- Owners receive booking requests and may accept or reject based on availability
- Upon acceptance, payment is made via the platform, including:
- Rental fee
- Any required security deposit(s)
- Applicable taxes or service charges
The platform confirms bookings only when payment is successful.
3. Renter Obligations and Usage Rules
The Renter agrees to:
- Use the vehicle solely for lawful, personal, or authorized commercial purposes (e.g., corporate events) or as authorized at the point of rentage.
- Provide a rider with a valid driving license to be authorized by PickARide, as self-driving services are currently not provided by the platform
- Abide by mileage or area restrictions if specified by the Owner
- Return the vehicle on time and in the condition it was received, with reasonable allowances for wear
- Immediately report any damages, accidents, or breakdowns to the Owner and platform
Driving by unauthorized persons or sub-renting the vehicle is strictly prohibited.
4. Owner Responsibilities and Insurance Disclosure
The Owner must:
- Ensure the vehicle is clean, functional, and roadworthy at handover
- Provide valid documentation and emergency contact details
- Disclose insurance coverage (third-party or comprehensive) and any liability limits as the
case may be.
The Owner may charge a security deposit and deduct from it in cases of damage, excessive
lateness, or fuel depletion.
5. Damages, Liability, and Dispute Resolution
- The Owner must report the issue within 2 hours and provide evidence (photos, mechanic’s report)
- The platform may intervene to mediate and determine fault
- If the damage is not covered by insurance, the renter may be charged repair costs or have it deducted from their deposit
- Injuries, fines, or criminal violations incurred during rental
- Mechanical failures unrelated to renter conduct
6. Cancellation, Refunds, and Penalties
- Renters may cancel with at least 24 hours’ notice for a full or partial refund, depending on Owner’s listing terms
- Cancellations under (less than) 24 hours may result in partial refunds or forfeiture
- Owners who cancel accepted bookings without cause may be penalized or suspended, especially for repeated incidents
Refunds (where applicable) are processed within 7 business days.
7. Commissions and Payouts
- PickARide.ng deducts a 10% commission from every successful rental
- Remaining funds (minus any damages or adjustments) are paid to the Owner via the preferred withdrawal method
Rental proceeds are disbursed only after the return of the vehicle and final confirmation of the
rental’s success.
8. Modifications to the Terms
PickARide.ng may, at its sole discretion, revise, update, or amend these Terms and Conditions from time to time to reflect:
- Changes in the platform’s features or business model,
- Legal or regulatory developments,
- Improvements in customer service or platform security.
When we make significant updates, we will update the “Last Modified” date at the top of this policy and notify users via email or in-app pop ups (where feasible). Users are responsible for reviewing the Terms regularly.
Your continued use of the platform after such changes constitutes acceptance of the revised terms and conditions.
